Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") constitute a binding legal agreement between you and Manna Kingdom Inc., a Florida corporation ("Company," "we," "us"). By accessing or using mannakingdom.com (the "Site") or purchasing products or services from us, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use our Site.

2. Eligibility

By using the Site you represent that you have the legal capacity to enter into these Terms in your jurisdiction. Accounts may not be used to purchase on behalf of others without their authorization. We reserve the right to refuse service at our discretion.

3. Products and Pricing

All prices are in USD. We reserve the right to modify prices at any time without notice. Product listings are for informational purposes and do not constitute a binding offer until payment is confirmed. We reserve the right to cancel orders at our discretion, including in cases of pricing errors or suspected fraud. Card grades and conditions are our good-faith assessment; grading is subjective and we cannot guarantee third-party graders will assign the same grade.

4. Authenticity Guarantee

We authenticate all cards and collectibles before listing. If you receive an item that is materially different from its description, or that is confirmed counterfeit by a reputable third-party grader (PSA, CGC, or BGS), contact us within 7 days of delivery for a full refund. This guarantee does not cover normal variance in condition grading opinions.

5. Box Breaks

Box break slots are purchases of participation rights - not guaranteed card outcomes. You acknowledge that: (a) collectible card games involve randomized pack contents; (b) there is no guarantee you will receive any card of particular value; (c) break results are determined by random lot assignment or team assignment at stream time; (d) all breaks are recorded and the recorded footage is the authoritative record of results; (e) no refunds are given for break results regardless of outcome, unless we cancel or fail to complete a break, in which case a full refund will be issued.

6. Memberships and Subscriptions

Membership subscriptions are billed monthly or annually. You may cancel at any time; cancellation takes effect at the end of the current billing period. We do not offer prorated refunds for partial months. Annual membership holders who cancel within 30 days of initial purchase receive a full refund. We reserve the right to modify membership benefits with 30 days' written notice. Benefits are personal and non-transferable.

7. Store Credit

Store credit has no cash value, does not earn interest, and cannot be transferred. Store credit expires 24 months after issuance if no purchases are made. We are not responsible for lost or stolen store credit codes or account credentials. Store credit is not redeemable for cash under any circumstances.

8. Shipping and Title

Title and risk of loss pass to you upon carrier pickup. We are not responsible for delays, damage, or loss by carriers after handoff. For items lost or damaged in transit, file a claim with the carrier; we will assist with documentation. See our Shipping Policy for details.

9. Returns and Refunds

See our Returns Policy for the complete return process. All return requests must be submitted within 7 days of confirmed delivery. Opened sealed product and digital items are non-returnable. See our Returns Policy at /returns.

10. Intellectual Property

All content on the Site - logos, text, images, designs, and code - is owned by Manna Kingdom Inc. or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works without written permission. Trading card artwork and brand marks (Pokemon, Magic: The Gathering, etc.) are owned by their respective rights holders; we use them for descriptive purposes only.

11. User Accounts

You are responsible for maintaining the security of your account credentials. Notify us immediately at admin@mannakingdom.com if you suspect unauthorized access. We are not liable for losses caused by unauthorized account access resulting from your failure to maintain credential security. We may terminate accounts for violation of these Terms.

12. Prohibited Uses

You agree not to: (a) use the Site for any unlawful purpose; (b) purchase for resale without disclosure; (c) manipulate prices or engage in market fraud; (d) submit false or fraudulent orders or chargebacks; (e) attempt to reverse-engineer or circumvent Site security; (f) create multiple accounts to abuse promotions.

13. Disclaimer of Warranties

THE SITE AND ALL PRODUCTS ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED OR ERROR-FREE. SOME STATES DO NOT ALLOW DISCLAIMER OF IMPLIED WARRANTIES; IF APPLICABLE LAW PROHIBITS SUCH DISCLAIMER, THE FOREGOING MAY NOT APPLY TO YOU.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY FLORIDA AND APPLICABLE LAW, IN NO EVENT SHALL MANNA KINGDOM BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, ARISING FROM YOUR USE OF THE SITE OR PURCHASE OF PRODUCTS. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID IN THE LAST 12 MONTHS, OR (B) $100.

15. Indemnification

You agree to indemnify and hold harmless Manna Kingdom, its officers, employees, and agents from any claims, damages, or expenses (including attorneys' fees) arising from your use of the Site, violation of these Terms, or violation of any third-party rights.

16. Governing Law and Jurisdiction

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-law provisions. Any dispute not subject to arbitration (see Section 17) shall be brought exclusively in the state or federal courts located in Florida, and you consent to personal jurisdiction in those courts.

17. Binding Arbitration and Class Action Waiver

PLEASE READ THIS SECTION CAREFULLY - IT AFFECTS YOUR LEGAL RIGHTS.

You and Manna Kingdom agree that any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Site (a "Dispute") shall be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court, except that either party may bring claims in small claims court if the claim qualifies.

Class Action Waiver: YOU AND MANNA KINGDOM AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. No arbitration award may grant relief to any person other than you individually without our consent.

To initiate arbitration, send a written Notice of Dispute to admin@mannakingdom.com. We will attempt to resolve the dispute within 30 days before arbitration may be commenced. The arbitration will be conducted in Florida or by telephone/video at your election. The arbitrator's decision is final and binding. You have the right to opt out of this arbitration clause within 30 days of first agreeing to these Terms by emailing admin@mannakingdom.com with subject "Arbitration Opt-Out."

18. Changes to Terms

We may modify these Terms at any time. Material changes will be communicated by email 30 days before taking effect. Continued use after effective date constitutes acceptance. If you do not agree to modifications, close your account before the effective date.
